Abstract

The development of contract law is no longer limited to the fulfillment of formal requirements under Article 1320 of the Indonesian Civil Code but also emphasizes the protection of weaker parties through the doctrine of abuse of circumstances. This normative legal research employs statutory, case and conceptual approaches to analyze the Langsa District Court Decision No. 8/Pdt.G/2023/PN Lgs. The court annulled Addendum No. 21 due to defects of consent, imbalance of bargaining positions and the absence of a legal basis for changes to PAD targets, while reaffirming the principles of good faith and fairness. This decision reflects legal protection for weaker parties and highlights the need for explicit regulation and consistent application of these principles in Indonesian contract law.
